‘Bow to the Emperor’:
We Asked 50 Legal Experts About the Trump Presidency

Before the election, we surveyed the legal establishment about what a second Trump term could mean for the rule of law. A year later, they’re very, very worried.

We recently returned to our group (50 legal experts of both parties) with a new survey and follow-up interviews about Trump’s impact on the rule of law since retaking office. The responses captured almost universal fear and anguish over the transformation of the Justice Department into a tool of the White House. Just as chillingly, the new survey reflects near consensus that most of the guardrails inside and outside the Justice Department, which in the past counterbalanced executive power, have all but fallen away.

The indictment of James Comey, the former F.B.I. director whom Trump ordered the Justice Department to charge, represents a misuse of power for many of our respondents that they hoped never to see in the United States.

Our President is following the pattern of dictators.

Dictators typically gain power through a combination of strategic, social, and political maneuvers, often exploiting weaknesses in existing systems or societal conditions.

They position themselves as saviors, promising order and stability.

Many dictators initially gain power legally, using democratic processes to their advantage. They may win elections or secure key positions, then dismantle checks and balances.

Dictators often use propaganda to build a cult of personality, portraying themselves as indispensable leaders. Joseph Stalin’s Soviet regime mastered propaganda, controlling media and education to shape public perception.

By pitting groups against each other—ethnic, religious, or class-based—dictators create loyalty among certain factions while marginalizing others.

Once in power, dictators weaken judicial systems, legislatures, and free press to prevent challenges.

If you disagree, tells us how none of this applies or is not representative of what has and is happening since Mr Trump was elected.

There is nothing as refreshing as a tall glass of Kool-Aid and it’s so easy to get people to take a sip. Gotcha‼️

  1. Rob, it all matters.

“The responses captured almost universal fear and anguish over the transformation of the Justice Department into a tool of the White House. “ But that transformation started long before even the Trump 1 administration. My past comments on this site have identified that. The challenge isn’t new, and certainly not new solely because the idiot ass Trump was reelected. What we need today is someone to step up and stop the insanity.

“Just as chillingly, the new survey reflects near consensus that most of the guardrails inside and outside the Justice Department, which in the past counterbalanced executive power, have all but fallen away.” Jim Comey was no guardrail, Merrit Garland was no guardrail, Letitia James was no guardrail. Jack Smith was no guardrail, Peter Strzok and Lisa Page were not guardrails … I can go on and on and on. Again, what we need today is someone to step up and stop the insanity.

“The indictment of James Comey, the former F.B.I. director whom Trump ordered the Justice Department to charge, represents a misuse of power for many of our respondents that they hoped never to see in the United States.” Agree, and see my prior comment. He is not innocent, but, still, what we need today is someone to step up and stop the insanity.

“Stalin”? Give me a break. Trump is no Stalin. Has he opened up a gulag or two? Remember, it was the progressives favority son, FDR, who imprisoned japanese americans during WWII. Why didn’t FDR incarcerate german americans? In prior posts, I noted that FDR also tried to suppress free speech when individual’s criticized the New Deal.

“If you disagree, tells us how none of this applies or is not representative of what has and is happening since Mr Trump was elected.” I would go on with more examples, but clearly, all you want to do is post a toothbrush moustache on Trump.

He is no Hitler, he is no Stalin, he is no Mao, he is no Pol Pot. Hell, he isn’t even FDR who, among other things, successfully threatened the Supreme Court into submission.

Stop already! Keep claiming he is Hitler or Stalin and he will likely continue this crap for the next 3+ years. Stop and let’s see if someone takes away his phone and his pen (other than with regard to legislation passed by Congress).

    1. When you say Trump is not any of those dictators when it comes to violence, etc., you are right, but there is no denying his tactics, propaganda, scapegoating, efforts to subvert opposition and consolidate power are all out of the strategy playbook of those people. All that is missing is physical attacks on groups or individuals.

The Project 2025 playbook is naive and dangerous, but in the hands of a Trump personality even more so. He is following it very closely despite not knowing anything about it. Sadly, it is not in the best interest of the vast majority of Americans.

      1. So, when folks call him EVIL, HITLER, STALIN, whatever, why is anyone surprised by his response?

When he is indicted and arrested and impeached, where we now know much of that was crap, why is anyone surprised about his response?

This crap has been going on since 2016. Stop!

Started with Russian collusion – clearly determined to be a bogus claim, oppo research by the Clinton campaign.

Continued with the Ukranian phone call – obviously, projection by the D’s given the Bidens’ dirty hands (as documented in recent revelations).

        https://www.realclearpolitics.com/articles/2025/10/07/emails_biden_demanded_cia_coverup_embarrassing_ukraine_intelligence__153374.html

If the D’s take back the House in the 2026 mid-terms, does anyone believe the House won’t impeach Trump a third time? “Show me the man and I’ll find you the crime.” Lavrentiy Beria

How about some balance – Abraham accords, the current attempts in Gaza, the border, etc.

Claims that he is Stalin were in this post. Hitler claims in many others. Keep it up and those around him will never be able to throttle him back.

        Stop. Stop!

      2. Stop what? Pointing out his behavior and where he is taking us? What should happen to oppose this? I’m open to suggestions. Will it all just go away before permanent damage is done?

      3. Stop suggesting Trump is Hitler, or Stalin, or that those folks who voted for him are Nazis.

Don’t publish/repeat others who do use those terms.

You’ve got folks suggesting that if they had two bullets, and three targets, a Republican political opponent, “Gilbert, Hitler, and Pol Pot,” “Gilbert (the Republican) gets two bullets to the head,”

Or, “… If those guys die before me, I will go to their funerals to piss on their graves”

Or, “I mean do I think Todd and Jennifer (Gilbert) are evil? And that they’re breeding little facists? Yes”

Or, “(I’m hoping) Jennifer Gilbert’s children would die.”

And, when asked whether that Democratic candidate should step aside, they have no guts … and refuse to drop him from their party, drop him from the current race.

        Stop. Stop I say!

    2. I’m no historian, but logic tells me that FDR had support for Japanese interment camps because of a direct attack on American soil at Pearl Harbor. Don’t recall any similar successful German attack. And no Gulags? Tell that to the immigrants sitting in detention camps without even due process.

      Like

      1. Sorry, but isn’t this entire post focused on how EVIL Trump is, how he is a Hitler or Stalin wannabe? That’s absurd, of course.

In terms of justification for placing Japanese Americans in camps, what law did they break? For comparison, illegal immigrant detainees all broke American laws to come here. The detention centers in America clearly aren’t Gulags. Keep in mind those are the same centers created and used by prior presidents – including Democrats – for the exact same purpose. Why are the illegal immigrants there, why are they being detained … wait for it … due process of course. And, they will generally get a better hearing here than they would in their own, native country.

In terms of singling out japanese americans (immigrants, first and second generations), it wasn’t the attack on Pearl Harbor that triggered rounding them up, which was mostly limited to the West Coast., and, amazingly, they didn’t round up japanese americans who were living in HAWAII. Subsequent analysis showed the primary reason for the camps was economic, to steal the farm lands, and other property … mostly prompted, whipped up, by agricultural groups.

We even had a US Supreme Court decision confirming the detention camps were legal. See: Korematsu vs. US. Of course, this was the same idiot, gutless Supreme Court that had been threatened into submission by FDR, including absolutely stupid decisions such as the one that precluded an Ohioan from growing wheat/grain to feed his farm animals and for personal consumption. See: Wickard v. Filburn.

FDR was as much and simetimes more of an authoritarian than the idiot ass Trump.

Perhaps you forget the German American Bund which was organized in America to promote Nazis – which wasn’t disbanded, even after many Americans were killed transporting weapons and material to England – until Germany declared war on America. https://en.wikipedia.org/wiki/German_American_Bund

And, German spies and saboteurs expected Americans of German descent would welcome and assist them. https://cupola.gettysburg.edu/cgi/viewcontent.cgi?article=1099&context=ghj

    1. The Trump Administration would get much further, and calm folks down (at least me) if after indicting Comey and James, they don’t further pursue litigation. Let’s hope the Atlanta lawfare is put to a stop, as well. Simply make the case to Americans via news media, social media, and in current and future elections and walk away.

Both Comey and James abused their office and political power. Both directed others to engage in lawfare. The idiot ass Trump should direct the Justice Department to stand down, and not repeat the Biden Administration and New York, Atlanta and other abuses of law.

I’ll always remember how he admitted to intentionally sending in agents to trap Flynn and how the agents discouraged Flynn from having legal counsel present. He admitted (gloated) in a TV interview that he personally made the decision to send a pair of agents to interview Flynn in 2017 – acknowledging he intentionally avoided the typical process for dealing with someone at the White House: “something I probably wouldn’t have done or maybe gotten away with in a more … organized administration.’ …”If the FBI wanted to send agents into the White House itself to interview a senior official, you would work through the White House counsel, and there would be discussions and approvals and who would be there.” … “I thought: ‘It’s early enough, let’s just send a couple guys over.’”

Then there was overstepping his authority in July 2016 (nothing to see in Hillary emails) and again in October 2016, which allowed Loretta Lynch to hide in plain sight (after her meeting with Bill Clinton on the Phoenix Sky Harbor tarmac), along with the FBI’s efforts chasing Trump per his direction, leaks to the NY Times, etc. … there is a lot to criticize here.

For comparison, Peter Navarro is also an idiot ass. When he is on TV, I turn off the volume or change the station. But, what the FBI did to him is also unconscionable – after deciding to arrest the 70+ year old fool for a misdemeanor, the FBI followed him, called CNN to film the arrest, knew he was not armed, arrested him at National Airport, put him in handcuffs and leg irons, and perp walked him out of the airport. As a non-violent offender, even after conviction, the judge did not let Navarro remain out of prison even though his appeals are still pending today.

Or, consider the pre-dawn raid of 66 year old Roger Stone in his pajamas with a dozen special agents clad in tactical gear with assault weapons, banging on his door, before dawn at his home, filmed by CNN. Why wasn’t there a no-knock if he was so dangerous as to warrant a dozen FBI agents to effect an arrest on non-violent charges?

Mr. Comey didn’t even get a perp walk, more than a week after his indictment on felony charges, he was allowed to enter the court through a back door, plead not guilty and walk away.

Also, you can’t ignore recent Senate hearings about Biden supression of free speech.

Let’s hope James doesn’t get a perp walk in front of the cameras, that Fani Willis and Comey and James all fade into the sunset, and, that more intelligent folks prevail, allow the defendants to move on, allow all of us to move on.
